The Code of Administrative Offenses refers only to the fact that you can’t open fire in a residential building or in the immediate vicinity of it, as well as in the immediate vicinity of the playground and garages. But it should be borne in mind that these norms were prescribed for a long time, when barbecues in general and pressed charcoal in particular were not particularly common. Today there is no exact interpretation of whether barbecues are open fire.

  • for lighting a fire that caused a fire and resulted in the death of a person - imprisonment for up to 7 years.

Legal grounds

Russian laws do not provide for direct liability for the barbecue on the balcony. Among the punishable administrative violations, the conversation is only about open fires, bred in a residential building or near it. It is also forbidden to make fire near playgrounds or stationary garages. These laws were written for a long time and do not take into account all modern realities. In those years portable braziers and pressed charcoal were not so widespread for them. Modern barbecues technically do not give an open flame, therefore legislative acts can be interpreted in two ways in relation to them.

Law enforcement agencies, along with the fire inspectorate, are usually involved in interpreting the laws in their favor, so it is possible to legally challenge their fines in court. If you are caught at the "crime scene" when you are grilling kebabs on the balcony, legal disassembly is possible. For making a fire in a residential building, the owner can be punished with an amount in the range of 100-420 thousand rubles. Based on the Administrative Code of the Russian Federation Art. 20.4 (as amended on 01.29.2018) you are facing:

  • Under the declared fire regime, the fine increases to 2-4 thousand rubles.

In this case, fines from fire supervision from 100 to 420 thousand rubles are possible.

If the fire starts through your fault, you are threatened:

  • For damage to health and property - a fine of 4-5 thousand rubles. (Administrative Code of the Russian Federation, Art. 20.4),
  • For grave harm to health or property - a fine of 80 thousand rubles or imprisonment of up to 3 years (Criminal Code of the Russian Federation (as amended on December 31, 2017) Article 216),
  • If a person died due to a fire - imprisonment of up to 5 years (Criminal Code of the Russian Federation (as amended on December 31, 2017) Article 216),
  • The same, but the death of two or more people - imprisonment of up to 7 years (Criminal Code of the Russian Federation (as amended on December 31, 2017), Article 216).

Installing a hood does not reconcile you with the fire department and neighbors.

Fire in residential buildings qualifies as a violation of public order, and you need to (and will) contact the police.

But you need to understand that from a legal point of view a person needs to be literally grabbed by the hand, that is, to catch him at the moment when he cooks barbecue on the balcony. If this happened, the consequences can be very sad:

  • If a fire is made in a residential building, then a fine for individuals can vary from 5 thousand to 400,000 rubles,
  • If due to a fire in a block of flames, a fire occurred and a fire was recorded that led to damage to property of other persons, then in accordance with the Criminal Code, persons responsible for lighting a fire are punished with correctional labor. In addition, the court may decide to arrest for several months or to restrict freedom,
  • In those situations when a diluted fire in a living room caused a fire in which a person was injured or people died as a result of a fire, a guilty person may be sentenced to imprisonment for a term of 7 years.

We can definitely say that cooking kebabs on the balcony is not recommended.

In addition, the systematic cultivation of open fire will adversely affect the finishing materials of the balcony and the entire apartment, because they will darken and lose their appearance.
